A Directive was issued from the European Parliament and the Council in 2003 with minimum requirements regarding information on a company’s website.
Notice was given to all SCO about these new requirements.
Whenever a company represents itself or addresses the public by using a website certain information must appear from the website:
- The name of The company
- The legal form of the company (e.g. A/S, ApS)
- The location of the registered office
- The registration number of the company and sufficient information to identify the particular register (e.g. in Denmark the CVR-register)
- Information about the capital subscribed and paid up where mention of the capital of the company is made
- Where appropriate, the fact that the company is being wound up.
The stipulations of the Directive are minimum requirements and more strict regulations can be issued by the Member States.
It is therefore recommendable that local attorneys are consulted in case of doubt.
Late implementation of the Directive may also be the reason why the question suddenly arises again in some countries.
